By placing an order with Cup & Box, you agree to the following terms and conditions.

1. Orders & Approval

All orders are subject to a minimum order quantity of 10,000 units unless specified.

Shipping rates fluctuate, so please confirm for a final price.

Customers are responsible for supplying accurate design files, logos, text, artwork, and label content.

We provide digital mockups or samples for customer approval before production.
-
Once the customer has approved the design, Cup & Box is not responsible for spelling mistakes, labeling errors, artwork issues, or regulatory non-compliance.

2. Design & Printing
​

All designs must be signed off by the customer before printing.
-
By approving the design, the customer accepts full responsibility for layout, text, artwork, colors, and legal compliance (including food, hygiene, or safety labeling).

No refunds, cancellations, or design changes are possible once production has begun.
-
Cup & Box may display finished packaging as non-confidential samples (on our website, marketing, or social media). Customers requiring confidentiality must request this in writing before production.

3. Customer Content & Intellectual Property

Customers warrant that they own or are licensed to use all artwork, branding, and text they supply.
-
By supplying content, customers grant Cup & Box a non-exclusive, royalty-free license to use that content solely to create proofs, manufacture products, and fulfill orders.

Cup & Box is not liable for any intellectual property disputes arising from customer-provided designs.

Customers indemnify Cup & Box against any claims relating to copyright, trademarks, labeling, or regulatory content.

4. Proofs & Color Accuracy

No job enters production without written proof approval.
-
Customers are fully responsible for reviewing and approving proofs.
-
Minor variations in color, print alignment, size, coating, or lamination effects may occur due to the printing process and are not considered defects.
-
RGB/Pantone to CMYK conversions may cause color shifts. Hard-copy proofs for color matching are available at extra cost and lead time.

5. Overruns & Underruns
​

Industry standard tolerances apply: deliveries may be ±5% of the ordered quantity.
-
Customers are invoiced for the actual shipped quantity.

6. Returns & Refunds
​

Because products are custom-made, all sales are final.
-
Returns are not accepted unless goods are proven defective or materially different from the approved proof.
-
Determination of defect is at Cup & Box’s discretion.
-
Slight print variations do not qualify as defects.

7. Payments
​

Standard terms: 50% deposit before production begins and 50% balance before shipping.
-
Production does not start until the deposit clears.
-
Orders are not released for shipping until the final balance is paid in full.
-
Late or non-payment may cause delays, storage charges, or cancellation.

8. Cancellations
-
Orders cancelled before proof approval may incur up to a 15% pre-press fee.
-
After proof approval and release to production, orders cannot be cancelled or refunded.

9. Production & Delivery
-
Lead times begin only after (i) deposit payment and (ii) written proof approval.
-
Timelines are estimates only. Cup & Box is not liable for delays caused by factories, carriers, customs, or other third parties.
-
Risk of loss transfers to the customer once goods are collected by the carrier.
-
Customers must inspect goods on receipt and notify Cup & Box of any issues within 5 business days with photos and order details.
10. Shipping & Logistics

Cup & Box manages logistics but is not liable for carrier delays, customs issues, weather, or third-party errors.

Prices shown on the website don't include shipping cost.
-
Incorrect or incomplete delivery addresses may incur re-shipment charges.
-
International customers are responsible for any duties, taxes, or customs clearance fees.
11. Regulatory Compliance

Customers are responsible for ensuring all packaging content (ingredients, nutrition panels, barcodes, warnings, recycling marks, etc.) complies with laws in the destination market(s).

Cup & Box does not provide legal compliance advice.
12. Satisfaction & Remedies

If goods are defective or materially different from the approved proof, Cup & Box may, at our discretion, reprint or issue a partial credit.

Cup & Box is not liable for consequential damages, lost profits, or business interruption.
13. Indemnification

Customers agree to defend, indemnify, and hold harmless Cup & Box and its affiliates from any claims, damages, or legal costs arising from:

Content supplied by the customer.

IP or copyright disputes.
-
Labeling or regulatory non-compliance.
-
Misuse of products.

14. Website Use & IP

All content on the Cup & Box website is owned by Cup & Box or our licensors.

Copying, scraping, or unauthorized use of our website or content is prohibited.
-
Users may not upload unlawful, infringing, or harmful material to the website.
15. Force Majeure

Cup & Box is not liable for delays or failure caused by events beyond our reasonable control, including natural disasters, strikes, government actions, supply-chain disruptions, or logistics issues.
16. Limitation of Liability

Cup & Box’s total liability is capped at the amount paid by the customer for the specific order in question.

Under no circumstances will Cup & Box be liable for indirect, incidental, or consequential damages.
17. Governing Law
